23XI, FRM request to compete amid NASCAR suit

23XI Racing and Front Row Motorsports, the two teams suing NASCAR , have "asked a judge for a preliminary injunction" so they "can compete under the charter system they are challenging" as their case moves forward. Jeffrey Kessler , the attorney hired by both racing groups in the lawsuit, said that the "two teams would sign the 2025 agreements if they receive a court order that would release them from a clause that prohibits teams from suing NASCAR." Kessler: "We would sign them if they if they cannot enforce the antitrust release. If we don't win the motion, then [the teams] will have to compete open." Front Row Motorsports owner Bob Jenkins said that the teams "could miss out on $45 million in combined revenue if they compete as un-chartered teams." But he added that he is "willing to do so," believing the case against NASCAR "is winnable" ( AP, 10/9 ).
